Probate is a court-supervised process that happens when a person dies either with or without a will and ensures the legal transfer of assets from the deceased to the rightful heirs or beneficiaries. With a few exceptions, assets outside of a trust, even if in a will, must go through probate before distribution. 

 

And, while we wish that everyone who has an estate potentially subject to probate had done prior planning to avoid the probate process, we realize that not everyone has before passing.
